Course Overview:

Labor laws in India have undergone significant changes with the introduction of four new labor codes aimed at simplifying and rationalizing existing labor legislation. This course provides a comprehensive understanding of both traditional labor laws and the new labor codes, covering topics such as employment contracts, working conditions, wages, social security, industrial relations, and legal compliance.

 

Course Objectives:

Module 2: Traditional Labor Laws

– Employment contracts: Types, elements, and enforceability.

– Regulation of wages, working hours, leave entitlements, and overtime.

– Health, safety, and welfare provisions under the Factories Act and other legislation.

 

Module 3: Social Security and Welfare Measures

– Employees’ Provident Fund and Miscellaneous Provisions Act.

– Employees’ State Insurance Act: Coverage, benefits, and administration.

– Maternity benefits, gratuity, pension schemes, and insurance coverage.

 

Module 4: Industrial Relations and Dispute Resolution

– Industrial Disputes Act: Recognition of trade unions, collective bargaining, and dispute resolution mechanisms.

– Strikes, lockouts, and legal remedies.

– Role of labor courts, tribunals, and conciliation officers.

 

Module 5: Overview of New Labor Codes

– Introduction to the new labor codes: Code on Wages, Code on Social Security, Code on Industrial Relations, and Code on Occupational Safety, Health & Working Conditions.

– Key provisions and objectives of each code.

– Implications of the new codes on existing labor laws and practices.

 

Module 6: Key Provisions of New Labor Codes

– Code on Wages: Minimum wage fixation, payment of wages, and related provisions.

– Code on Social Security: Universalization of social security benefits, gig workers, and platform workers.

– Code on Industrial Relations: Simplification of dispute resolution procedures, recognition of trade unions, and collective bargaining.

– Code on Occupational Safety, Health & Working Conditions: Standards for workplace safety, health, and welfare.
