INTRODUCTION

Trademark is a type of intellectual property right  consisting of recognizable design, sign, expression that identities product or service from a particular source and differentiates it from other source. A trademark owner can be an individual person, business organization, or any legal entity. A trademark may be located on a package, a label, a voucher, or on the product itself.  The owner of trademark may pursue a legal suit for the infringement if any of the rights of owner is violented.

A trademark is a special symbol or combination of symbols that is used to identify a company or its goods and services. As long as the proper documentation and fees are submitted and the symbol or set of words is utilized, it cannot be used indefinitely by any other organization or individual.Trademarks are perpetual in nature but the registration is granted for 10 years it has to be renew after every 10 years unlike patents, which are awarded for a 20-year period. It gives protection against copycats,counterfeiters businesses must submit an application for a trademark and obtain ownership confirmation. One of the main benefits of using symbols and phrases is that we are able to quickly identify with businesses and their brands and also infringement which has happened. A customer’s fast awareness of a well-known brand or phrase can lead to preference and, eventually lead to increase in sales.

In that instance, Bisleri granted Coca-Cola permission to sell and export goods into and out of India under the Maaza trademark, and shortly after, Bisleri filed a trademark application in Turkey. It was decided that Coca-Cola had full ownership and can enjoy  the trademark and Bisleri was not permitted to use it inside or outside of India.

WHATMAN INTERNATIONAL LTD V. P MEHTA AND OTHERS

The well-known Indian case in which the defendant, who took advantage of Whatman’s goodwill and damaged several of the plaintiff’s intellectual property rights during the previous 25 years, paid Whatman an enormous sum of 3.85 crores. The counterfeit filter sheets, which were identical replicas of the plaintiff’s filter paper and were being sold by the defendant under a number of different trademarks, were permanently halted in this highly publicized case, which revealed the actual worth of the trademark.

N.R. DONGRE V. WHIRLPOOL CORPORATION

It was decided that because WHIRLPOOL has long been exclusively associated with WHIRLPOOL CORPORATION, its reputation extends to India, and as a result, even registered users in that country are not permitted to use the aforementioned trademark for the same or comparable goods.

Starbucks faced Indian infringers who used Sardar instead of Star, deceptively misleading people. The court allowed Starbucks to use modified Sardar Baksh and allowed future lawsuits against those using Baksh.

REMEDIES AND PENALTIES AGAINST TRADEMARK INFRINGEMENT

Civil Liabilities: Orders

Temporary Injunction:

A court can order that prevents the trademark infringements from using the mark until the proceedings is resolved.

Permanent Injunction:

It is a long-term injunction which will stops the trademark infringement victim from exploiting brand.

Damages: Restitution for monetary losses or harm to one’s reputation brought on by the violation.
